Grand Rapids Online Auction Terms and Conditions

This is a legal agreement between you, the user or buyer, and The SITE OWNER or Grand Rapids Online Auction & Estates, LLC.  Grand Rapids Online Auction & Estate, LLC may be referred to as "us", "we", "our".  "The site" refers to our website, www.gronlineauction.com or "company".  Note to the buyers of titled items: Buyers will be responsible for taxes and plates at their local Secretary of State office.  Titles will be given day of sale if paid by Cash, Credit Card, or Certified Check. 

Acceptable forms of payment are cash, credit card, or debit card (run as credit). There is a $45.00 fee for all returned checks.

Any theft or violation of the rules will result in immediate termination from our site, www.gronline.com.  Please read the terms below and if you agree, then enter our site.  If you do not like or agree with our terms, then please do not enter as all terms and conditions will be enforced.  The Site may contain errors, omissions, inaccuracies, or outdated information.  Furthermore, the Company does not warrant reliability of any statement or other information displayed or distributed through the Site. The Company reserves the right, at its sole discretion, to correct any errors or omissions in any portion of the Site. The Company may make changes to this Site at any time without notice.

You must be at least 18 years old to bid.

Everything is sold "as-is", where-is with absolutely no returns or refunds. All items are described and photographed to the best of our ability.  If you are uncertain about an item or need more information, then you need to come view it in-person.

Grand Rapids Online Auction Services provides auction services. The seller of any particular items pertains to titles and all incidents of ownership with regards to that item prior to sellers property not taking ownership.

Use of our services/site is at your sole risk. Neither Grand Rapids Online Auction Services or its affiliates, nor any of their officers, directors, employees, agents, third-party content providers, or licensors (collectively , “The Company”) or the like, warrant that these services/site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of these services/site.  Or as to the accuracy, completeness, reliability, security, or currency of these services/site.  Our services/site may contain errors, omissions, inaccuracies, or outdated information.  Further, Grand Rapids Online Auction does not warrant reliability of any statement or other information displayed or distributed through our services/site.  The Company reserves the right in its sole discretion to correct any errors or omissions in any portion of our services/site. The Company may make any other changes to its services/site anytime without notice.  The Company will make reasonable commercial effort to make our services/site available at all times, however, the Company is not responsible for any service interruptions, including, but not limited to, interruptions that may affect aspects of the sale of merchandise.  Our services/site and the information, content, and merchandise sold on the site are provided on an “as is”, “where is” and “where available” basis.  The Company makes no representations or warranties of any kind express or implied, as to the operation of the site, the content, information, or the materials on the site.  To the fullest extent permissible under the applicable law, the Company expressly disclaims all warranties, expressed or implied, of any kind, with respect to any of the materials/merchandise, content, or information on this site or any goods or other products or services offered, sold, or displayed on this site or your use of this site generally, including warranties of merchantability, accuracy of information, quality, title, fitness for a particular purpose, and non-infringement.  Some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above disclaimer may not apply to the extent such jurisdiction’s law applies to this agreement.  In the event that you have a dispute with one or more users, you release the Company from claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.

All items must be paid for and picked up during the specified hours posted in the Announcement portion of the Online Auctions category page.  Please refer to the "How to Buy" page for further information about pickups.  If you fail to do this, your bidding privileges will be revoked and the items will be reposted. If you make arrangements and do not follow thru with them, you will be charged per day until you pick your items up.

We reserve the right to retract, cancel, or reopen bidding on any item we deem necessary.  ALL ITEMS on the auction sell subject to the Grand Rapids Online Auction & Estates, LLC acceptance or rejection of the high bid.

By placing a bid on an item, you are entering into a legally binding contract.   All bids made within 10 minutes of the scheduled close of the auction will extend the auction close 10 minutes until there is no bidding activity for 10 minutes. If you fail to follow through with this contract, we will enforce it to the fullest extent of the law.  Placing a bid on an item means that you agree to and will abide by all of the terms and conditions set forth by Grand Rapids Online Auction.

Every item sold has a 6% tax added unless noted otherwise or we have a valid copy of your sales tax license on file.

The Buyer agrees to pay a 10% "Buyer's Fee" for every lot they win on the auction or 7% for those paying with cash.  For every lot sold for over $1,000.00 the Buyer's Fee is reduced to 6% or 3% for those paying with cash.

You expressly agree that use of this Web site is at your sole risk.  Neither Grand Rapids Online Auction & Estates LLC, its affiliates, nor any of their officers, directors, employees, agents, third-party content providers, or licensors (collectively, “the Company”), or the like, warrant that this Site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of this site, or as to the accuracy, completeness, reliability, security, or currency of the Site.

LIMITATION OF LIABILITIES:
YOU AGREE THAT PROVIDER AND ITS THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGE, LOSS, OR EXPENSE OF ANY KIND ARISING OUT OF OR RESULTING FROM YOUR POSSESSION OR USE OF THE MATERIALS, CONTENT, OR INFORMATION ON THIS SITE OR FROM YOUR PURCHASE OR SALE OF GOODS THROUGH THIS SITE REGARDLESS OF WHETHER SUCH LIABILITY IS BASED IN TORT, CONTRACT, OR OTHERWISE. IN NO EVENT, INCLUDING, WITHOUT LIMITATION, A NEGLIGENT ACT, SHALL THE COMPANY OR ANY OF ITS PROVIDERS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OR CORRUPTION OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR INTERRUPTION OF BUSINESS), ARISING OUT OF OR IN ANY WAY RELATED TO THE MATERIALS, CONTENT, OR INFORMATION ON THIS SITE OR ANY OTHER PRODUCTS, SERVICES, OR INFORMATION OFFERED, SOLD, OR DISPLAYED ON THIS SITE, YOUR USE OF, OR INABILITY TO USE, THIS SITE GENERALLY, OR OTHERWISE IN CONNECTION WITH THIS AGREEMENT, REGARDLESS OF WHETHER THE COMPANY OR ANY OF ITS PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

The BUYER expressly agrees to indemnify and save the Grand Rapids Online Auction & Estates LLC, Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, (including, but not limited to, attorney's fees), directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of the Grand Rapids Online Auction & Estates LLC, or anyone acting in his/her behalf in connection with or arising out of auction, except that the BUYER shall not be responsible to the Grand Rapids Online Auction & Estates LLC for damages caused by or resulting from Grand Rapids Online Auction & Estates LLC  sole negligence.

All sales are made on an AS IS - WHERE IS WITH ALL FAULTS basis.  All items sell AS IS - WHERE IS WITH ALL FAULTS and with no warranty of any type expressed or implied as to the merchantability or fitness for any particular purpose of any goods offered in this sale.  BUYER understands that any description given in the catalog or written on the equipment is not guaranteed, and BUYER will rely entirely on their own inspection.

Do not bid unless you agree to all of the terms above. By bidding and registering on this website you are acknowledging agreement with the terms above.
